Separation
South Carolina does not recognize what is commonly referred to as "legal separation." The action in this state is for "separate maintenance and support." Typically, this action is appropriate for individuals who have child issues and financial issues that need to be in place during the one-year separation period. This is not an action for divorce; divorce is initiated in a separate action after the one year period expires. A separate maintenance and support action can address any issue including custody, child and spousal support, property division and attorney fees.
