Aviation Accidents
The standards applicable in aviation accidents depend on whether the litigation involves a “common carrier” or a private operator. Common carriers are heavily regulated by the government, whereas private operators are generally required to simply act in a reasonable manner under the circumstances. An initial inquiry in aviation litigation, therefore, is which type of operator is involved. Further, because aviation is a highly technical field, expert testimony is frequently necessary to prove whether the operator is liable for injuries caused in an accident.
