Slip and Fall

Every person has a duty to reasonably observe where he or she is walking.  Sometimes, however, a person’s reasonable conduct cannot prevent them from slipping and falling.  The owner or person in control of the premises therefore has an obligation to take reasonable precautions to protect people.  The scope of the duty owed by the owner or controller depends on whether the injured person is an invitee, a licensee, or a trespasser.  Generally there is no duty to warn of or protect from obvious dangers, and the duty to warn or protect with respect to hidden dangers typically arises only if the owner/controller knew or should have known that a danger existed.
